TERMS & CONDITIONS

Please read the terms and conditions carefully before booking your session. Your session payment signifies acceptance of these terms and conditions as a legally binding contract:

 

Booking and Payment - Family / Newborn / Branding Sessions 

  • The full session deposit of £99 is payable in full within 48 hours to secure the booking and retain the Photographer to perform the services detailed herein.

  • Prices are shown in GBP. Payments can be made by bank transfer or PayPal.

  • Once payment has been received, Claire Roads Photography will reserve the time/date agreed upon and will not make other reservations for that time and date.

Booking and Payment - Motherhood Sessions 

  • The full session fee of £150 is payable in full within 48 hours to secure the booking and retain the Photographer to perform the services detailed herein.

  • Prices are shown in GBP. Payments can be made by bank transfer or PayPal.

  • Once payment has been received, Claire Roads Photography will reserve the time/date agreed upon and will not make other reservations for that time and date.

 

Cancellation/ Postponement 

  • The client acknowledges that the session fee is non-refundable in the event of cancellation by the client.

  • Session fees are transferable if a date change is necessary, however 48 hours’ notice is required, and postponement will be subject to the photographer’s availability. 

  • Sessions can only be postponed by the client twice; if a session needs to be rescheduled a third time, the session fee will be forfeited.

  • If the appointment must be cancelled by the photographer due to adverse weather conditions a new, mutually agreed appointment will be made. However, if the Client would like a Session Fee refund, this will be granted.

  • In the unlikely event that the Claire Roads Photography needs to cancel (and the session cannot be postponed to a new appointment) the full session fee will be returned to you .  

 

Failure to Perform

  • If the Photographer cannot perform this Agreement due to a fire, illness, casualty, act of God, or other cause beyond the Photographer’s control, then the Photographer shall return to the Client any funds previously paid but shall have no further liability with respect to the Agreement.

  • This limitation on liability shall also apply in the event that photographic images are lost through camera or card malfunction, equipment theft, accident or any other circumstances beyond the Photographer’s control, liability is limited to funds paid only.

  • Photographing any specific moment is not guaranteed. Although all possible care will be taken to produce images of all important or special moments during the session, the Photographer cannot place an unconditional guarantee on the above.

 

Completion Schedule

  • Editing of images will be completed within 14 days from the date of the session.

  • Images will be available for viewing for 48 hours via a password protected online gallery of low-resolution watermarked proof images.

  • Images shown to the Client are at the discretion of the Photographer and images not shown as final proofs will be purged after the initial processing stage. The Client will not be given access to the unedited images from the photo session.

  • During the 48-hour window the Client can choose their favourite images to be included in their chosen package. Please choose images carefully. Once print or digital products are prepared, designed or ordered, sales are final, and no refunds will be given. Due to the nature of photographic products, images/products cannot be returned.

  • After the 48-hour period has passed, the gallery will be archived and an administration fee of £15 may be chargeable to reinstate access.

  • Please note that whilst Claire Roads Photography aims to produce approx. 25-30 edited images from each Family / Newborn Session (and 10-15 edited images for a Motherhood Session) this may not always be possible.

 

Online Gallery

  • The photographer cannot be held responsible for the quality of viewing online galleries, in regard to client screen size and detail, or accurate colour reproduction of their viewing device.

  • Clients do not have permission to screenshot, download or otherwise copy the images provided on the online gallery. Regardless of intent for use, this is considered a breach of copyright.

Copyright, Reproduction & Model Release

  • Copyright in all photographs remains with Claire Roads Photography. Purchasing digital images or prints does not transfer copyright to the Client.

  • Images may not be copied, reproduced, scanned, screen-grabbed, downloaded from online proofing galleries, or otherwise duplicated without the Photographer's permission, except where expressly permitted under the Client Usage section below.

  • The Client confirms that they are aged 18 or over and, where photographs include anyone under the age of 18, that they are the parent or legal guardian of those individuals, or otherwise have the appropriate authority to agree to the relevant terms on their behalf.

Client Usage

  • The Client may use purchased digital images for personal use and share them online, provided the images are not altered from the versions supplied by the Photographer.

  • Purchased images may not be altered, manipulated, filtered, or used to create derivative images without the Photographer's prior written permission. This includes using AI tools or software to change the appearance or content of an image.

  • Images may not be used for commercial purposes, competitions, exhibitions, advertising or other promotional purposes without the Photographer's prior written permission, unless that use has been specifically agreed as part of the booking.

  • Images supplied as proofs, previews or watermarked gallery images are for viewing and selection purposes only. They are not licensed for download, reproduction, publication or use unless and until the relevant image has been purchased and supplied as a final image.

AI Use, Watermark Removal & Unpurchased Images

  • The Client must not upload, submit or provide any photographs supplied or displayed by Claire Roads Photography to an AI tool, image editor or other software for the purpose of removing watermarks, bypassing purchase requirements, recreating an unwatermarked version, or otherwise obtaining or using an image that has not been purchased.

  • The Client must not remove, obscure, crop out or digitally alter any watermark or copyright notice on an image supplied or displayed by the Photographer.

  • The Client must not use AI tools or other software to create, reconstruct or generate an unwatermarked copy of an image from a watermarked proof, preview, screenshot or other image that has not been purchased.

  • Permission to view or access an image in an online gallery does not grant permission to download, reproduce, publish or otherwise use that image. Only images purchased by the Client and supplied as final files may be used, subject to the usage rights above.

  • Any additional permission to use, reproduce or alter an image must be agreed in writing by the Photographer.

 

Image Production

  • Claire Roads Photography fully edits all images before presenting to the client and non-permanent minor scratches, bruises and blemishes will be removed during processing.

  • An editing fee of £10 per photo will apply for any editing requested by the Client that is outside the realm of normal editing, depending on the extent of the work.

  • The Photographer will edit the images in either colour or black & white depending on which suits the image best and to the discretion of the Photographer. If the Client wishes to purchase an image in an edit not shown, the cost is £10 per photo to cover additional editing.

Prints

  • All images produced by Claire Roads Photography are done on a fully calibrated monitor, and all prints ordered directly through Claire Roads Photography will be a true reflection of the editing carried out.

  • Claire Roads Photography will not be held responsible for variances in images caused by clients viewing images on non-calibrated screens, monitors or poor-quality printing.

 

Use of Pictures

  • At times, Claire Roads Photography may use session images for the purpose of sales, advertising, or promotion on it’s business website or social media.  

  • Posts will not include names or any personal information about the subject(s).  If you do not wish to have your images shared, please email claire@claireroadsphotography.co.uk

 

Travel Expenses

  • All travel expenses are based on the distance between the Session location and the business address (ME15, Kent) For all Family / Newborn Sessions, the first 15 miles of travel is included, for Motherhood Sessions, the first 10 miles of travel are included. 

  • All miles in excess of the above will be charged at 55p per mile.

 

Camera Policy

  • Cameras, camera phones, camcorders or any other recording equipment (outside of those being used by the Photographer) are not permitted during any session due to the distraction it can cause.

 

Prices

  • All prices are subject to change without notice by Claire Roads Photography (outside of session).

  • No consideration will be given to previous client experience regarding product pricing, availability, package structure, or session fees.

 

Privacy
Claire Roads Photography will never share, or allow to be accessed, shared or distributed, any personal or contact information of any client or enquiry obtained by any means. 

 

By submitting payment of the Session Fee, the Client confirms they have read and fully understand the contents of this Agreement.
